Terms of service

Last updated

These terms of service (Allgemeine Geschäftsbedingungen) apply to Plus for Things 3, the service we host at things3.plus. Please read them before you sign up. The privacy policy explains how we handle your data. If you run the public source code yourself, section 21 explains what applies.

1. Who we are and what these terms cover

Plus for Things 3 (the “service”) is provided by the following company (“we”, “us”):

Grzzly Enterprises UG (haftungsbeschränkt)
c/o Tobias Pörtner
Winsstr. 23
10405 Berlin
Germany

Managing director (Geschäftsführer): Tobias Pörtner
Commercial register: Amtsgericht Kiel, HRB 25176 KI
VAT ID: DE361132006
Email: support@things3.plus

“You” means the person or business using the service. These terms apply to consumers (Verbraucher, § 13 BGB) and businesses (Unternehmer, § 14 BGB). Where a section applies only to consumers, it says so. Your own terms and conditions do not apply, even if we do not object to them.

The contract language is English. These terms are always available on this page, and you can save or print them. We keep every earlier version and send it to you on request.

2. What the service does

Plus for Things 3 adds features to Things 3 that the app does not offer itself. It works alongside your Things apps through Things Cloud: you keep using Things as before.

Today the service consists of the Cloud MCP connector, the web app and sharing. The Cloud MCP connector connects an AI app you use, such as Claude, ChatGPT, Claude Code or Cursor, to your Things 3 data through Things Cloud. Your assistant can then read and change your tasks, even when your Mac and phone are switched off. The web app shows and changes your Things data in your browser. Sharing lets people you invite work on the same project in their own Things apps.

To do this, we keep an encrypted working copy of your Things data on our servers, check every change before we send it to Things Cloud, and keep receipts so that changes can be undone. The privacy policy explains the details.

You decide what your assistant does with your Things data, and you are responsible for the changes you ask it to make.

Coming features. We develop the service further. On our website we announce features we are working on and mark them “Coming soon”; at present these are sync with Notion and Toggl, and attachments. A coming feature is not part of the service, and not part of what you pay for, until we release it. We do not promise that, or when, a particular feature will be released. When we release a feature, it becomes part of both plans, the monthly and the lifetime plan, without extra charge (section 6).

3. An independent, unofficial service

  • Plus for Things 3 is an independent, unofficial service. It uses Cultured Code’s Things Cloud in the same way the Things apps do. Cultured Code offers no public interface for this.
  • Plus for Things 3 is not affiliated with or endorsed by Cultured Code GmbH & Co. KG. Things and Things Cloud are trademarks of Cultured Code.
  • Cultured Code can change Things Cloud at any time, without telling us. Such a change can interrupt or limit the service, temporarily or permanently. Sections 12, 13 and 17 explain what happens then.
  • Your Things Cloud account remains subject to Cultured Code’s own terms.

4. Your account and signing in

  • You create your account in one of two ways: with “Get started” on our website, or when you connect an AI app to the service. Either way, you sign in with the email address and password of your Things Cloud account and accept these terms. We use your password once to obtain your account’s access key and never store it (see how we handle your password).
  • You may only connect a Things Cloud account that you are entitled to use: your own, or one whose holder has authorised you.
  • You must be at least 18 years old.
  • If you suspect that someone else is using your account, change your Things Cloud password (this revokes our access at once) and tell us.

5. How a contract is concluded

  • Free trial. After you sign in, on our website or from your AI app, the “Choose how to start” step shows the free trial and the paid plans. Clicking “Start free trial” concludes a free contract for the trial.
  • Paid plan. You choose the monthly or the lifetime plan on the “Choose how to start” step, on our plan page or on the account page. We then send you to Stripe’s checkout page, which shows the plan, the price including VAT and, for the monthly plan, that it renews every month. Until you click the final payment button you can correct your entries on that page or go back and choose differently. Clicking the payment button is your binding order. The contract is concluded when Stripe confirms your order; we then unlock your plan and confirm it by email.

6. Plans and prices

Plan Price What you get
Free trial free for 7 days the full service without a card; once per person
Monthly €5 per month, or US$5 outside the euro area the full service; renews every month until you cancel
Lifetime €69, paid once, or US$69 outside the euro area the full service for the life of the service (section 11)

All prices include VAT. You pay in euros if you are in a country that uses the euro, and in US dollars everywhere else. We go by the country you visit our website from. Your first trial or purchase sets the currency for your account, and it stays the same after that. Stripe’s checkout page shows the price in your currency before you pay. We charge nothing else. Costs for your internet connection, your Things apps and your AI app are your own.

Each hosted plan covers one person’s Things Cloud account. Each participant in a shared project needs their own hosted plan.

What “the full service” includes. Both plans include every feature of the service that is available when you buy, and every feature we release later, from the day it is released. The only exception is usage-based add-ons, which we may offer in the future: optional extras whose price depends on how much you use them. We would offer them separately and show their price before you choose one; you never need one to keep using your plan.

7. The free trial

  • The trial lasts 7 days. It starts when you click “Start free trial” on the “Choose how to start” step. You need no card, nothing is charged, and it ends by itself.
  • You can use the trial once per person. We recognise a used trial by a keyed hash of your email address, also after you delete your account.
  • If you choose the monthly plan during your trial, you keep your free days: the first payment is taken when the trial ends (if more than two days of the trial are left; otherwise at once). The lifetime plan is charged at once.
  • When the trial ends without a plan, your assistant can no longer use your Things data until you choose a plan. Your connection stays and nothing is deleted; your assistant gets a link to the plans. We email you two days before the trial ends and when it has ended.

8. Paying, renewal and cancellation

  • Payments are processed by Stripe with the payment methods shown at checkout.
  • The monthly plan is paid in advance and renews automatically every month until you cancel it.
  • You can cancel the monthly plan at any time, without notice period and without giving a reason: on the account page under “Manage billing”, or by email to us.
  • A canceled monthly plan keeps working until the end of the period you have paid for. Your connection stays. When the period ends, your assistant can no longer use your Things data; choosing a plan again brings it back without reconnecting.
  • If a monthly payment fails, we email you and Stripe tries again. The service keeps working for 7 days; after that it pauses until the payment succeeds or you choose a plan.
  • If you buy the lifetime plan while a monthly plan is running, the monthly plan ends at once and is not charged again.
  • Disconnecting does not cancel a monthly plan. “Delete everything” cancels any subscription at once (section 16).

9. 14-day money-back guarantee

  • Within 14 days after any payment, for the monthly or the lifetime plan, you can ask for your money back by emailing us at support@things3.plus. We refund that payment in full. You do not need to give a reason.
  • We refund to the payment method you used, within 14 days of your request.
  • The plan that the refunded payment was for ends with the refund.
  • Canceling a plan or deleting your account does not refund anything automatically. Within the 14 days, just email us.
  • We may refuse a refund if the same person repeatedly buys and refunds plans.
  • The guarantee is in addition to your statutory rights, including the right of withdrawal (section 10).

10. Your right of withdrawal (for consumers)

If you are a consumer, you have a statutory right of withdrawal (Widerrufsrecht) of 14 days. The withdrawal instruction is in Annex 1, and a model withdrawal form is in Annex 2. An email to us is enough.

When you choose a plan, we start providing it at once. By law you could then owe us compensation for the time until you withdraw. We do not charge it: if you withdraw, we refund everything you paid under that contract.

11. The lifetime plan

  • The lifetime plan is a single payment for access for the life of the service: for as long as we operate Plus for Things 3. It is not a promise that the service will exist forever.
  • It includes every feature we build for the service, now and in the future, except possible usage-based add-ons (section 6). A coming feature is included from the day it is released; the lifetime plan is not a promise that a particular feature will be released (section 2).
  • It covers one Things Cloud account. It is personal and cannot be transferred.
  • If we shut the service down within 6 months of your purchase, you get the full price back. If we shut it down within 12 months of your purchase, you get half of it back. We refund it to the payment method you used, without you having to ask.
  • After 12 months, a shutdown gives no right to a refund, unless the law provides otherwise.
  • The lifetime plan ends if you delete your account or get your payment refunded.

12. Availability and the status page

  • We run the service with care, but we do not guarantee any particular uptime, and there is no service level agreement.
  • Our status page shows the current state of the service and known issues.
  • Maintenance may interrupt the service briefly.
  • A change to Things Cloud can interrupt the service (section 3). We then work to restore it as quickly as we can.

13. Outage credit

If the service is largely unusable for more than 3 days in a row because of a change to Things Cloud, you receive a pro-rata credit for each day of the outage:

  • Monthly plan: 1/30 of the monthly price per day, credited against your next payment, or refunded if no further payment follows.
  • Lifetime plan: 1/365 of the lifetime price per day, refunded to the payment method you used.

To receive the credit, email us within 30 days after the outage has ended. The credit does not limit your statutory rights.

14. Fair use

  • Daily limits per account keep the service fast and reliable for everyone and keep our requests to Things Cloud within what it allows.
  • When your account reaches a limit, your assistant can still read your tasks as they were last loaded, but changes and fresh loads from Things Cloud pause until the next day. Your assistant tells you when this happens. If you need more, email us.
  • We do not publish fixed numbers, because we adjust the limits to protect the service.

15. Acceptable use

You agree not to:

  • connect a Things Cloud account you are not entitled to use;
  • share a paid plan among several people, or resell or rent out access;
  • create automated load that goes beyond your own use of your assistant;
  • get around limits, the one-trial rule, payment or any security measure;
  • attack, probe or overload our systems, or interfere with other users;
  • use the service for anything unlawful.

If your use puts the service, other users or our access to Things Cloud at risk, we may limit or suspend your account. We act proportionately and warn you first where possible. If we end your account permanently although you are not at fault, we refund the unused part of a monthly period you paid for, or, for a lifetime plan, the amount that section 11 gives for a shutdown at that time.

16. Your data, disconnecting and deleting

  • Your Things data stays yours. We use it only to provide the service, as the privacy policy describes.
  • Disconnect (on the account page) deletes your access key and our working copy of your data. Your plan stays, and you can reconnect at any time from your AI app.
  • Delete everything (on the account page) deletes your account, your connection, your settings and our working copy. Any subscription is canceled at once, without an automatic refund; section 9 still applies. A lifetime plan ends. Your tasks in Things are not affected.
  • Keep your own backups of your Things data. Changes your assistant makes reach Things Cloud and your devices within seconds. We check every change before sending it, keep receipts, and offer undo and a read-only mode, but no system can rule out every error.

17. Changes to the service and ending the contract

  • We develop the service further. We add features (section 2), and they become part of both plans when we release them (section 6). We may change existing features where this is reasonable for you and does not substantially reduce what you paid for. For consumers, the statutory rules on changes to digital products apply (§ 327r BGB).
  • If we shut the service down, we tell you by email at least 30 days in advance. A monthly plan then ends on the shutdown date, and we refund the unused part of the period you paid for, pro rata. For the lifetime plan, section 11 applies.
  • We can end a monthly plan with at least 30 days’ notice by email, effective at the end of a billing period.
  • Both sides can end the contract for good cause without notice (§ 314 BGB).

18. Liability

We are liable without limitation:

  • for intent (Vorsatz) and gross negligence (grobe Fahrlässigkeit);
  • for injury to life, body or health;
  • under the Product Liability Act (Produkthaftungsgesetz);
  • where we have guaranteed a particular quality (Beschaffenheitsgarantie) or fraudulently concealed a defect.

For slight negligence, we are liable only for breaches of essential contractual obligations (Kardinalpflichten): obligations whose fulfilment makes the proper performance of the contract possible in the first place and on which you may regularly rely. In that case, our liability is limited to the damage that is foreseeable and typical for this kind of contract.

In cases of slight negligence, our liability for the loss of data is limited to the effort that would have been needed to restore the data if you had kept backups appropriate to the risk (section 16).

Otherwise our liability is excluded. These rules also apply to the personal liability of our employees, representatives and agents. Your statutory rights as a consumer, and claims under the GDPR, are not affected.

19. Statutory warranty

If you are a consumer, the statutory rules for digital products apply (§§ 327 ff. BGB). The service must match what these terms describe, and you have the statutory rights if it does not.

20. Changes to these terms

  • We may change these terms for a valid reason, for example a change in the law or in case law, a change to Things Cloud, a new feature, or a security requirement.
  • We tell you about every change by email at least 30 days before it takes effect, with the new text and an explanation of what changes.
  • Changes that affect the price or the main features of your plan, or that are otherwise material, apply to you only if you actively agree to them. If you do not agree, the current terms continue to apply to you; our right to end a monthly plan under section 17 remains.
  • Other changes apply from the date stated in our email unless you object before that date. We point this out in the email. If you object, the current terms continue to apply to you.
  • You can cancel a monthly plan at any time (section 8).

21. The self-hosted version

  • The source code of Plus for Things 3 is public on GitHub. It is source-available under the Business Source License 1.1 (the “licence”), whose full text is in the file LICENSE there.
  • Under the licence you may run a single instance for your own personal use, connected to your own Things Cloud account and used only by you. You may not offer it, or any service based on it, to others as a hosted or managed service, whether free or paid. Four years after a version is first published, that version becomes available under the Apache License 2.0. Only the licence decides what you may do with the code; this summary does not change it.
  • The self-hosted version is not a service we provide. You run it yourself, on your own computer or server, at your own responsibility. It comes without support, without warranty and without any promise of availability or updates. Our self-hosting guide explains how to set it up.
  • It is free: there is no trial, plan or payment.
  • Features that connect several people, such as sharing and collaboration, need the hosted service. A self-hosted instance serves one person only.
  • Like the hosted service, it uses Things Cloud in an unofficial way (section 3). A change to Things Cloud can stop it from working.
  • We receive no data from a self-hosted instance (see the privacy policy).
  • These terms govern the hosted service. Apart from this section, which points you to the licence, they do not apply to the self-hosted version.

22. Governing law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer and live in another country, you keep the protection of the mandatory consumer law of that country (Art. 6(2) Rome I Regulation).

23. Consumer dispute resolution

We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle). If something goes wrong, please email us first; most problems are solved with a refund or a fix.

24. Final provisions

If a provision of these terms is invalid, the rest remain valid, and the statutory rules apply in place of the invalid provision.
